DMCA Designated Agent Directory
Copyright notices and counter-notices should be sent to the designated agent listed above. Service-provider and agent details should be kept consistent with the active U.S. Copyright Office designation. Do not use the DMCA contact for ordinary account support, password recovery, moderation disagreements, privacy requests, or general business inquiries.
Submitting a Copyright Infringement Notice
If you are the owner of an exclusive copyright right, or are authorized to act on the owner’s behalf, and you believe material available through ProfoundSyntax infringes that right, send a written notice to the designated DMCA agent.
To be effective under the DMCA notice-and-takedown process, the notice should include substantially all of the following:
- Your physical or electronic signature, or the signature of a person authorized to act for the copyright owner.
- Identification of the copyrighted work claimed to have been infringed. If a single notice covers multiple works at one online site, you may provide a representative list of those works.
- Identification of the material claimed to be infringing, or the reference or link to that material, together with information reasonably sufficient for ProfoundSyntax to locate it. Whenever possible, include the exact ProfoundSyntax URL.
- Information reasonably sufficient for ProfoundSyntax to contact you, such as your mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the owner’s agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.
A notice that does not substantially contain the required information may be delayed or may not constitute effective notice under 17 U.S.C. § 512.
What Happens After a Notice
ProfoundSyntax may review the notice and the identified material. When appropriate, ProfoundSyntax may remove or disable access to material claimed to be infringing and may take reasonable steps to notify the member who posted the affected material.
ProfoundSyntax may contact the complaining party for clarification when a notice does not provide enough information to identify the copyrighted work, locate the challenged material, or determine whether the notice substantially satisfies the applicable requirements.
Counter-Notification
If material you posted was removed or disabled following a copyright notice and you believe the removal resulted from mistake or misidentification, you may send a written counter-notification to the designated DMCA agent.
To be effective under the DMCA process, a counter-notification should include substantially all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which ProfoundSyntax may be found, and that you will accept service of process from the person who submitted the original notification or that person’s agent.
Restoration After a Counter-Notification
After receiving a substantially compliant counter-notification, ProfoundSyntax may provide a copy to the person who submitted the original copyright notice and inform that person that the removed material may be restored.
When the statutory process applies, ProfoundSyntax may restore the material not less than 10 and not more than 14 business days after receiving the counter-notification unless the designated agent first receives notice that the complaining party has filed a court action seeking to restrain the member from the allegedly infringing activity.
Repeat Infringers
ProfoundSyntax has adopted a policy providing for termination, in appropriate circumstances, of members who are repeat infringers. ProfoundSyntax may consider valid copyright notices, other reliable information concerning repeated infringement, and the circumstances of the account when applying this policy.
ProfoundSyntax also intends to accommodate and not interfere with applicable standard technical measures as required by law.
Attempts to evade a copyright-related account restriction through alternate accounts may also violate the Rules and Terms of Service.
Misrepresentations
Knowingly making a material misrepresentation that content is infringing, or that removed content was removed by mistake or misidentification, may result in liability under applicable law. Submit notices and counter-notices carefully and in good faith.
Fair Use, Licenses, and Other Lawful Uses
Not every use of copyrighted material is infringement. A use may be authorized by a license, permission, fair use, another statutory exception, or other applicable law. ProfoundSyntax does not provide legal advice about whether a particular use is lawful.
No General Duty to Monitor
ProfoundSyntax may use moderation and abuse-prevention systems, but this Copyright / DMCA procedure does not create a promise to proactively monitor every Thread, reply, link, code sample, image, or other member submission for possible copyright infringement.
Other Intellectual-Property Concerns
This page addresses copyright notices and counter-notices. Trademark, confidentiality, privacy, impersonation, or other legal concerns may require a different process. Use Help or the appropriate site reporting channel for matters that are not DMCA copyright notices.
Privacy and Records
Copyright notices and counter-notices may contain personal information and legal statements. ProfoundSyntax may retain and disclose information from these communications as reasonably necessary to process the request, notify affected parties, maintain legal and security records, respond to legal process, or protect rights. See the Privacy Policy for additional information.
Changes to This Procedure
ProfoundSyntax may update this Copyright / DMCA procedure to reflect changes in law, service operations, or contact information. The Effective Date above identifies the current version.
